.WHAT DOES IT INVOLVE?

Real Estate Acquisition in Mexico

Under Mexican law there two legal mechanisms that can be used in order to buy a property. The first of them is the acquisition through a bank Trust (fideicomiso) and the second is the direct acquisition, usually a sale agreement "escritura".

Within 50 kilometers of the borders and in the Federal District, there is only one way person can hold realestate…. the fideicomiso (Trust) approach.

The Trust in Mexico has the following characteristics:
1- The Trust must be constituted with the participation of a Mexican credit Institution authorized by Banco de Mexico, usually a Bank.
2- The Trust Deed must be granted before a Public Notary with the presence of a representative of the Fiduciary Department of the Bank.
3- The Trustee can appoint beneficiaries in case he or she dies and is empowered to freely sell, mortgage or transfer his or her trust rights to whomsoever person. However the bank charges a fee for any deed it signs.
4- The banks charge an acceptable annual fee. Those fees vary from Bank to Bank
5- No probate is required in the appointment of beneficiaries, any relative or friend can be appointed.

Dis
advantages:
- The payment of an annual cost is increasing every year.
- The Bank must sign any legal document related to the property on Trust.

The direct acquisition option has the following characteristics:

1- Under Mexican Federal law in order to buy a property any foreigner must submit an "agreement of acquisition" before the Secretariat of Foreign Affairs (Secretaria de Relaciones Exteriores). Once submitted a confirmation reply must be given to the buyer within 8 working days and the cost currently is MN$ 300.00 per person.
2- The aforementioned procedure must be carried out by each person that buys a property. This is, in case married couples buying a property, two applications are required.
3- Pursuant to article 1893 of the State of Jalisco Civil Code the buyer can appoint beneficiaries. However the beneficiaries can only be ancestors, parents, descendants, and spouses.
4- No probate is needed in case beneficiaries are appointed in accordance to article 1893.
 

Advantages:
- only a single small payment must be made for the attainment of the "confirmation reply". Afterwards there are no further charges.
- You can freely dispose of your property without the need of getting the bank representative's signature.

Disadvantages:

- The appointment of beneficiaries is limited to ancestors, descendents, and spouses. No other relatives, companies or friends can be your beneficiaries.
- It takes 8 working days to obtain the confirmation reply.


 
What option is better?
It all depends on your personal situation. If you are planning to appoint your parents, descendants, husband, wife as your beneficiaries  I would say that the direct acquisition would be the best option, since you are going to save a good deal of money on the long run. On the other hand, if you want to appoint another relative or simply a friend, then you should choose the trust option  This applies only to direct ownership, of course.
