In
accordance with the “Antiterrorism and Effective Death Penalty Act of 1996,” as
codified at 28 U.S.C. § 2255, effective April 24, 1996, before leave to file a
second or successive motion can be granted by the United States Court of
Appeals, it is the applicant’s burden to make a prima facie
showing that he satisfies either of two conditions stated below.

certified as provided in

Section 2255 by a panel of the appropriate court of
appeals to

(1) newly discovered evidence that, if proven and
viewed in light of the evidence as
a whole, would be
sufficient to establish by clear and
convincing

(2) a new rule of constitutional law, made
retroactive to cases on collateral
review by the
Supreme Court, that was previously unavailable.
